    Question:

    What is temporary partial disability?

video featuring workers' compensation attorney Phil Turcy

    Answer:

A lot of times we’ll get a call, and client says, “I’m hurt. My employer wants me to come back to work and work in a different job where I’m not being paid the same amount of money. Do I have to do it?” The answer is, yes, if you’re able to go back to work, even in a lighter duty capacity, and they can accommodate your work for you.

If you go back to work and they’re paying you less money, they have to compensate you for that differential. Even though you’re working, you’re making less money. We have to look and see what you would have made at your full pay rate. They have to compensate you for that difference from the insurance company. This can become a tricky part of a workers’ compensation claim. If you have a question about it or any other questions for your work comp claim, please feel free to call me.
