Should I speak to the insurance company for the nursing home?
A gentleman called our office a couple of weeks ago, and he wanted to prosecute a case for his mother who he believed had been abused in a nursing home. He wanted to know whether or not it was okay to speak to the insurance company and the lawyer for the insurance company about the claim. What we told him was absolutely not. You never want to speak to an insurance company or a lawyer for the insurance company while you yourself are unrepresented. The only reason the insurance company would be reaching out to you is to develop evidence that they can use at a later date to defeat your claim.
